All house plans purchased and/or licensed from Delta Home Plans, LLC (“Delta Home Plans”) are subject to the terms and conditions provided below.
Return Policy
House plans purchased and/or licensed from Delta Home Plans are non-returnable and non-exchangeable. In addition, the purchase price for a house plan purchased and/or licensed from Delta Home Plans is non-refundable. In other words, all sales are final, and no credits are allowed. Please choose your house plan wisely and carefully.
Ownership of House Plans
House plans purchased and/or licensed from Delta Home Plans are owned by the original designer of the house plan or the original designer’s assignee, if applicable. Purchasing and/or licensing a house plan from Delta Home Plans does not convey to the purchaser and/or licensor any ownership rights or ownership interests in the house plan.
Copyrights Protecting House Plans
House plans purchased and/or licensed from Delta Home Plans are protected under the Federal Copyright Act, Title XVII of the U.S. Code, and Chapter 37 of the Code of Federal Regulations. Purchasing and/or licensing a house plan from Delta Home Plans does not convey to the purchaser and/or licensor any ownership of the copyrights or any other intellectual property rights protecting the house plan. Reproduction of any house plan purchased and/or licensed from Delta Home Plans, either in whole or in part, including any form of copying and/or preparation of derivative works thereof, for any reason, is strictly prohibited without prior written and express permission from Delta Home Plans.
Restrictions on Use of House Plans
The purchase and/or license of a house plan from Delta Home Plans allows the purchaser and/or licensor of the house plan a limited license to use that house plan for the construction of one, and only one, dwelling unit. The purchase and/or license of additional sets of a house plan from Delta Home Plans at a reduced price from the original house plan, or as part of a multiple set package of the house plan, does not allow the purchaser and/or licensor to use the house plan, or additional sets of the house plan, or a multiple set package of the house plan, to construct more than one dwelling unit. Similarly, the purchase and/or license of reproducible sets of a house plan from Delta Home Plans does not allow the purchaser and/or licensor to construct more than one dwelling unit. To use a house plan purchased and/or licensed from Delta Home Plans to construct more than one dwelling unit, and to avoid any copyright/license infringement, the purchaser and/or licensor must contact Delta Home Plans to receive a release and license for any extended usage of said house plan.
Compliance with Building Codes and Engineering/Architectural Requirements
House plans purchased and/or licensed from Delta Home Plans are designed to meet most national building codes at the time the house plans were originally drawn. Because many states and parishes/counties amend their building codes, ordinances, regulations, and requirements, the purchaser and/or licensor of a house plan from Delta Home Plans is responsible for ensuring, and indeed has an obligation to ensure, that the dwelling is built in compliance with the applicable building codes, ordinances, regulations, and requirements, including permits and inspections at the time of and during construction. Furthermore, the purchaser and/or licensor of a house plan from Delta Home Plans is responsible for obtaining any and all structural and lot analysis, engineering/architectural stamps (if necessary), and specifications that may be required in the state and parish/county in which the dwelling will be built. The purchase and/or license of a house plan from Delta Home Plans is conditioned on these responsibilities and obligations.
Indemnification
All purchasers and/or licensors of house plans from Delta Home Plans hereby indemnify and hold harmless Delta Home Plans and its principals, employees, and agents, from any claim, loss, or liability resulting from the failure of the house plans purchased and/or licensed from Delta Home Plans to comply with the applicable building codes, ordinances, regulations, and requirements.
Warranties and Disclaimers
House plans purchased and/or licensed from Delta Home Plans are provided “as is” without warranty, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Delta Home Plans assumes no responsibility for errors or omissions in the house plans purchased and/or licensed from Delta Home Plans.
Delta Home Plans is not liable for plan interpretation, or the structural integrity of dwellings built from plans purchased and/or licensed from Delta Home Plans.
